Makani Catamaran – Terms of Service (Effective February 2026) This terms of Service is for daily FIT tours. If you booked a private charter, please refer to your charter contract
Acceptance Booking or boarding constitutes acceptance of these Terms of Service.e used when we need to send you promotional materials if you agree to this privacy policy.
Booking & Payment All reservations are confirmed upon receipt of full payment or deposit (as specified). Prices are in USD and subject to change without notice. Cancellations within 48 hours of departure are non-refundable. No-shows forfeit payment.
Weather & Safety Makani Catamaran operates rain or shine unless deemed unsafe by the Captain (e.g., high winds, lightning, heavy storms). In case of cancellation due to unsafe conditions, full refund or rescheduling is offered. Passengers must follow all crew instructions for safety. Life jackets are provided and must be worn when required.
Liability & Assumption of Risk Sailing involves inherent risks (waves, sun exposure, motion sickness, wildlife). By booking, you assume all risks and release Makani Catamaran, its owners, crew, and affiliates from liability for injury, loss, or damage (except for gross negligence). Minors must be accompanied by a responsible adult.
Health & Conduct Passengers must be in good health for sailing. No illegal substances, excessive alcohol, or disruptive behavior allowed. We reserve the right to refuse boarding or remove anyone posing a safety risk. No smoking onboard.
Personal Property We are not responsible for lost, stolen, or damaged personal items. Bring only what you can securely manage.
Photography & Media By boarding, you grant Makani Catamaran permission to use photos/videos taken during the sail for promotional purposes (website, social media, ads) without compensation.
Changes & Force Majeure Schedules, routes, or inclusions may change due to weather, mechanical issues, or unforeseen events. We will make reasonable efforts to notify you.
Governing Law These terms are governed by the laws of the State of Hawaii. Disputes will be resolved in Honolulu courts.
